Council takes business to court after its owner fails to produce waste documents

Pendle Borough Council took a business to court after its owner failed to produce his documentation for removal of business waste from his Nelson premises.

Mr Toqir Hussain, of Pendle Building Merchants Ltd, was found guilty at Burnley Magistrates Court.   

Mr Hussain, of Leeds Road, Nelson, failed to produce his Business Waste Duty of Care Permit when requested by a Pendle Council Enforcement Officer.

Mr Hussain was fined £293, ordered to pay costs of £428.75 and a victim surcharge of £34 – making a total of £755.75. The company was also fined exactly the same, bring the total ordered to pay to £1,511.50.

Councillor Asjad Mahmood, Leader of Pendle Borough Council, said: “People and businesses not abiding by the law must be dealt with. We have rules in place for a reason.”

David Walker, Pendle Borough Council's Assistant Director of Operational Services, added: “If an authorised officer of the Environment Agency or local authority asks a business to provide a written description of waste, or a copy of it, and they fail to do so, they can be issued with a fixed penalty notice - and this is what has happened on this occasion.

“This prosecution gives us the opportunity to show the local community – and in this case, businesses - that we take environmental crime very seriously.
