Nelson takeaway and its director fined for food hygiene offences

 

Kebabish KO Limited and Mr Nadeem Raza were jointly ordered to pay £9,448 when the case was heard at Preston Magistrates’ Court.

The Scotland Road eating establishment failed to ensure that:

• The premises were kept clean and maintained in good repair and condition
• Food was protected against contamination likely to make it unsafe to eat
• Food likely to support the growth of food poisoning bacteria was kept above 8°C
• A Food Safety Management System was in place based on the principles of Hazard Analysis and Critical Control Points (HACCP)
• Food handlers were supervised, instructed and/or trained in food hygiene matters
• The food business was registered with Pendle Borough Council

The Director, Nadeem Raza, in his personal capacity, received a fine of £480, reduced to £320 to reflect his early guilty plea. He was also ordered to pay a £128 victim surcharge and £150 towards prosecution costs, making a total of £598.

Kebabish KO Limited was fined £9,000, reduced to £6,000 due to an early guilty plea. The company was also ordered to pay a £2,000 victim surcharge and £850 towards costs, making a total of £8,850.

Councillor Asjad Mahmood, Leader of Pendle Borough Council, said: “Food businesses have a legal responsibility to maintain high standards of food hygiene, register with the Council, and take the necessary steps to protect public health.

“Our food officers work closely with businesses to provide advice and support; but where businesses fail to engage or meet their responsibilities, we will take appropriate action to protect residents and customers.”

Councillor Mohammad Hanif, Portfolio Holder for Finance, Health and Leisure, added: “If you run a food business and you have not already registered it with Pendle Borough Council, then it is imperative you do so.

“It can be easily done via the Council’s website and takes no time at all.”
