If consent is granted, there is a fee of £647.

When do I need consent?

If you trade in the street anywhere in Pendle, you need to apply for Street Trading Consent.

Before submitting your application, make sure that you:

• have completed the application form in full
• can fulfil the criteria outlined in Section 5 'Application Process' of the Policy document. You can request a basic disclosure certificate (DBS check) from the GOV.UK website
• can comply with all the licence conditions in Section 8 'Conditions should a Consent be granted to you'

Who can apply?

You must be over 17 years of age to hold a licence.

Consents are either granted in full, granted with amendments (e.g. times plus days) or refused. A set of conditions will be attached to all consents.

How do I apply?

New applicants

• Read the policy, and then contact the Licensing Office to discuss a suitable site. We advise that you do not buy any equipment before you have spoken to us 
• Complete the application form and send it to us with any required documents

After you have submitted your application, it is referred to Councillors, who can object. You may have to attend a committee meeting.

You only have to pay the fee once your application has been granted.

Renewing an application

The policy for street trading changed on the 1 January 2019.

The main changes are:

• you will need a Basic Disclosure (from the Disclosure and Barring Service (DBS)). The Disclosure must not be older than one month when you make your application
• you must attend Child Secual Exploitation (CSE) training
• traders using moving vehicles must supply extra documentation including current insurance, MOT and driving licence
• confirmation of registration as a food business is required
• rules around ice cream van chimes are now the same as DEFRAs Code of Practice
• there is now guidance for applicants with criminal convictions
• there is a new application form
• there is no restriction in trade around schools or other educational establishments

If you are an existing trader, you will trade under the provisions of the old policy, until your renewal is due. Once you renew your application, the new policy will apply.

Regulation summary

The powers to regulate and issue licences are contained in the Local Government (Miscellaneous Provisions) Act 1982.

The act defines street trading as "the selling or offering for sale of any article (including a living thing) in a street".
