Nelson man found guilty for six fly tipping offences

A 47 year old man from Nelson has been sentenced to 12 weeks in prison, suspended for 12 months, for fly tipping six times.

Ernest Taylor of Cooper Street, Nelson appeared in Burnley Magistrates' Court on Thursday 5th November 2009.

He pleaded guilty to all six counts of fly tipping.

Mr Taylor was also ordered to pay £260 towards the clean-up costs.

And he was made subject to a curfew order for four months. This order restricts his movements each day from 8pm until 6am the following day from Wednesday to Sunday.

Four of the six fly tipping offences happened in November 2008. Another happened in May of this year.

Mr Taylor was dumping rubbish he had been paid to collect from addresses across Lancashire in different places in Nelson, including Walverden Reservoir and the bottom of Lomeshaye Road.

Pendle Council staff investigated each fly tip separately. In each load of rubbish they found letters which they traced back to people who had employed Mr Taylor's business Rapid Waste to collect and dispose of their waste.

Mr Taylor first appeared at Reedley Magistrates' Court for these fly tipping offences on 15 October 2009, pleading guilty.

The cases were adjourned until 5th November for a pre-sentence report.

At last week's adjourned hearing Mr Taylor pleaded guilty to an additional fly tipping offence committed on 23 July 2009.

On this occasion Mr Taylor was caught on CCTV* dumping rubbish at Walverden Reservoir.

Councillor John David, who speaks up on fly tipping in Pendle, said:

"This is the toughest sentence the courts have imposed on a Pendle resident for fly tipping.

"If Mr Taylor fly tips one more time, he will find himself in prison.

"This really should serve as a warning to anyone tempted to dump their rubbish, instead of disposing of it correctly.

"Be aware that we can, and do, catch up with people who do this. You can't get away with it and the punishments are harsh and very real."
