Second Hand Goods Dealer Registration

Registering your business as a Second Hand Goods Dealer

The County of Lancashire Act 1984 requires anyone involved in the business of dealing in second-hand goods to register with the local authority in which s/he trades.

A registration certificate is not required for certain activities which are:

  • Charitable organisations
  • Scrap metal dealers
  • Motor vehicle traders
  • Persons engaged in dealing with waste paper, cardboard or plastics
  • Holders of a licence under section 22 of the Consumer Credit Act 1974 (i.e. those involved in credit or hire businesses)
  • Persons engaged in any business whose primary purpose is the supply of new unused goods and to which the supply of second hand goods is merely incidental

To register, you must complete an application form stating the name and address of the applicant together with the details of each place occupied by the applicant, within the Council's district, from which it is intended to trade in such goods. Return the form with the fee required to the address below.

Registration Requirements

Each certificate holder must keep a register at each of the premises within the Council's district at which s/he deals in second-hand goods sales. The register must be in the form of a bound book with consecutively numbered pages and must be kept until the end of a period of two years from the date on which the last entry was made in the register. Every transaction involving any acquisition of goods must be recorded in the register, along with the date of the transaction, quantity and description of the articles(s), the name and address of the person from whom the articles(s) was/were acquired and, where practicable, the registration number of any vehicle used by the seller to deliver the article(s) to the certificate holders premises.

Breaching any of these provisions constitutes a criminal offence.

A police constable is entitled to examine these records at any reasonable time.
