What happens when we receive your application?
Deciding on your planning application
Before a decision is made, the planning case officer dealing with your application will visit the site in order to assess the merits of the proposal, including its visual impact, relationship to neighbouring properties and effect on local amenities and traffic. They will take into account representations received during the consultation process. A report is then prepared outlining the officer's recommendation, which can be either to approve or refuse a planning application.
Planning decisions are made by either the Planning Manager or members of the relevant Area Committee (of which there are five in Pendle) depending on the scheme of delegation. Decisions made by the Planning Manager follow consultation with the Chair of the relevant Committee. The Committee considering the application may or may not follow the planning officer's recommendation.
Where an application is being determined at Committee, we will notify anyone who has made a representation. The applicants, their agents and members of the public, can speak at the meeting. Prior notice must be given to the Committee Clerk. The Committee agenda and officers' reports are available on the Council's web site and at the Town Hall, Nelson five working days before the meeting.
If the application fails to be determined by an Area Committee, it is then deferred to the Development Management Committee. Again, those who have made a representation are notified. Again, the applicants, their agents and members of the public, can speak at the meeting.
The decision
After an application has been determined a Decision Notice is sent to the applicant or their agent, stating that the application has been
approved or refused.

If the application has been approved the Decision Notice will specify the conditions under which planning permission has been granted. It is vital that these conditions are complied with, either before or during construction, or in the process of changing the use of premises.
Minor amendments can be made to an approved scheme without resubmitting the application.
If the application is refused the decision notice will give reasons why planning permission has not been granted. Applicants have the right to appeal against the decision.
One resubmission of an application may be made (fee exempt) within 12 months of the date of decision. The resubmission has to be made by the same applicant, be of the same type of development, and have the same application site boundary (red edge).
