How do I apply?
Pre-application advice
At Pendle we encourage people to discuss their proposals with us before submitting a planning application.
We have written a Guide to the Development Management Process, which we hope will give you a better understanding and answer any questions you may have.
With effect from 1st January 2012 we have introduced a new system of charges for pre-application advice. If your proposal is a large scheme of work please refer to the advice note we have produced which explains the new charging system, sets out the charges and advises how they are payable. For other proposals including householder please refer to our whats new section for the current schedule of charges.
Making the application
There are two ways you can apply:
- You can download the National Standard Planning Application Form (1APP), and associated guidance documents. Complete the form and return it to us; or
- You can apply online using the Planning Portal website
In most circumstances you will need to submit 1:1250 location plans and 1:500 site layout plans (please see the appropriate planning application validation checklist for the type of development you are proposing for more guidance on the plans/scales you will require). These plans are available to buy from Pendle Borough Council by completing the form Request for location and site maps for a planning application which should then be returned to us by post at Nelson Town Hall, by hand at No.1 Market Street or by email at planning@pendle.gov.uk along with the correct fee.

A Design and Access statement may also need to be submitted. If you do not fill in a Design and Access Statement when one is required, your application will not be considered valid.
The checklist for each type of application will tell you whether you need to complete a Design and Access Statement.
For small scale developments, for example...
- house extensions;
- minor changes of use without significant external alteration to a building;
- fencing;
- shopfronts (outside Conservation areas)
...you can use the Council's standard proforma.
In all other circumstances you should submit a full statement following the Council's guidance note.
Design and Access Statements will not be required for the following:
- A change of use of land or buildings (unless it involves building works).
- Engineering or mining operations.
- An extension to an existing dwelling or development within the site boundary of an existing dwelling, except where the dwelling is within a conservation area or a site of special scientific interest.
- Application to display an advertisement.
- Tree preservation order proposals.
- Hazardous substances applications.
How much will it cost?
The fees for planning applications are set under national planning legislation. They are not set by Pendle Borough Council.
- We are not able to process an application unless the appropriate fee has been received.
- We are happy to advise applicants of what the appropriate fee is for a development.
- Once a fee has been submitted for a valid application there is no refund available.
