Noise Nuisance from commercial or industrial premises
The Commercial Pollution Section within Pendle Borough Council's Environmental Health Services Department deals with complaints relating to noise nuisance from commercial and industrial premises, such as shops, factories and pubs.
If noise from such a premises is affecting you regularly you should contact the Environmental Health Services Department for assistance on 01282 661199. Details of your complaint will be taken and passed to an officer.
You will normally be asked to keep records for a few weeks showing how and when you are being disturbed by the noise. These will help us to assess the nuisance and decide how to proceed.
You will also be given details on how to contact the Night Noise Service. This Service operates every Friday and Saturday night between 8pm and 3am, and every Sunday on Bank Holiday weekends between 9pm and 1am. If you call the Service when you are being disturbed an officer will come to your house to witness the noise. Please note, officers cannot get the noise stopped.
If the noise is from a pub or club we will work with the Council's Licensing Department because the licence for the premises might include conditions to prevent public nuisance. We have produced guidance on preventing noise nuisance from licensed premises for those who manage pubs and clubs.
We may also install noise recording equipment in your property, or visit you when the noise is occurring to help us to assess the nuisance.
If we agree there is a statutory nuisance we will speak to the person responsible to try to resolve the problem informally. Your details will remain confidential unless you give us permission to identify you.
If the problem cannot be resolved informally we will serve an abatement notice and allow a reasonable time period for this to be complied with. If the notice is ignored, we will continue to gather evidence and prepare a prosecution case. If the charge is contested you will be asked to give evidence in court, because this will strengthen our case and improve our chances of success.
Where we don't agree that there is a statutory nuisance you will be advised to take private action.
