Dog Fouling in Parks and Cemeteries

Dog Fouling and Litter Dropping

Since September 2010 Pendle Borough Council's enforcement team have been patrolling all Pendle's Parks and Cemeteries, as well as other public areas in the borough.

They enforce by issuing fixed penalty notices to members of the public for dropping litter and not cleaning up after their dogs.

Under the Dogs (Fouling of Land) Act 1996, any person who permits a dog that is in their charge to foul any area to which the public has access is committing an offence.

It is an offence for a dog owner not to clean up after their dog in these areas. Failure to comply can result in a prosecution and fine of up to £1000 or the issue of a fixed penalty notice.

Cemeteries

The clean Neighbourhoods and Environment Act 2005 Dog Control order (prescribed offences and penalties, etc) Regulations 2006, Section 55 states that it is an offence for any person in charge of a dog in any of Pendle's Cemeteries to:

  • Fail to clean up forthwith after that dog fouls
  • Fail to put and keep the dog on a lead
  • Fail to put and keep the dog on a lead when directed to do so by an authorised officer
  • Bring into the Cemetery more than 1 dog

To report Dog Fouling

Please keep a note of dates and times you witness owners failing to clean up after the dogs have fouled.  Please assist us by providing a brief description of the dog and the owner. This may help to identify those responsible.
