Q: Do you need planning permision to erect decking in your garden, particularly if this then overlooks someone elses property?

Answer:

Planning permission for decking may be required depending upon a number of different circumstances.  It is not a simple yes or no answer.  It depends on where the decking is is in relation to the house (i.e. extension to the house or separate structure), how high it is above ground level, whether it has volume (i.e. is there space beneath it), whether the house has been extended previously, whether an engineering operation has been undertaken (e.g. excavation), whether it is nearer to a highway than the original house. 

The Local Planning Authority would require the submission of details (including scaled drawings) or alternatively the completion of a Permitted Development enquiry form.
